Please read these terms and conditions carefully before using Our Service.
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
When You create an account with Us, You must provide Us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.
You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password.
To ensure the safety and legitimacy of our community, "User" and "Gym Owner" accounts are subject to a verification process by the Administrator ("Admin"). This may require submitting valid identification, business permits, or other documents as requested during registration. The Admin reserves the right to approve or reject any application (including User, Coach, or Gym Owner) at their sole discretion, as per the verification process outlined in `admin_dashboard.php`.
Certain features of the Service require payment, including but not limited to User "Pro" upgrades, Gym Owner subscriptions, and User bookings.
You acknowledge and agree that FitCoachXpert (the "Platform") facilitates services and payments between Users, Coaches, and Gym Owners. In consideration for these services, the Platform charges a fee.
For every completed booking payment made by a User, a Platform Fee of ten percent (10%) of the total booking price will be automatically collected by the Platform.
This 10% fee is the Platform's earning. The remaining ninety percent (90%) of the booking payment will be distributed as earnings to the associated Coach (45%) and Gym Owner (45%). This revenue split is processed automatically via our payment system (as handled in `paymongo_webhook.php`).
Gym Owners are required to purchase a subscription ("Yearly" or "Lifetime") to access the platform's full features, including managing coaches, approving bookings, and receiving earnings. Subscription payments are processed via PayMongo and are credited in full to the Platform Admin.
Gym Owners may request a refund for a subscription payment via their "Subscription" page. All refund requests are subject to review and approval by the Admin. The Admin may approve or reject refund requests at their sole discretion, as handled in `admin_manage_refunds.php`. Approved refunds will be processed by the Admin.
Our Service allows You to post Content (e.g., profile pictures, gallery images, reviews). You are responsible for the Content that You post to the Service, including its legality, reliability, and appropriateness.
You may not use the Service for any illegal or unauthorized purpose. You agree to comply with all laws, rules, and regulations (e.g., federal, state, local) applicable to your use of the Service.
We may terminate or suspend Your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.
Upon termination, Your right to use the Service will cease immediately. This includes the "hard delete" of User accounts that are rejected during the verification process, as defined in `admin_process_user_verification.php`.
In no event shall FitCoachXpert, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
